Description

The owner of this Badge attended the course Telematic Civil Procedure-a training course and has successfully passed the final exam. The course is organised by University of Milano-Bicocca and sponsored by the Ordine degli Avvocati di Milano. The Telematic Civil Procedure has become mandatory for those whose professions involve relationships with the Courts since the 30th of June 2015 and it constitutes a direct practical application of legal and judiciary informatics, strictly related with civil procedure. The correct use of the specific software tools (digital signature, PEC and editor for the deposit of deeds and procedural documents) is part of the cultural baggage of the legal practitioner and of the student oriented to professional choices concerning the jurisprudential field. Lawyers, clerks, judges, technical advisers and general practitioners have to use IT and telematic tools daily in order to carry out their work. The purpose of the course is to analyse the definition of the main notions of the telematic civil procedure and the IT tools used by law firms and courts, providing the student with a complete framework of the advantages, critical issues and the evolution of the telematic civil procedure and of the justice system in general. The course has a 5 hour duration (4 hours for the lessons, 1 hour for the final exam) and it is periodically offered to a maximum of 20 students per session. During the lesson the professor explains the legal fundamentals of the Telematic Civil Procedure and illustrates the applications of the main informatics tools. For the students who choose to undertake an internship in a law firm, the professor will be available for telephone assistance for any problems that may arise. This activity is recommended for those students who have already passed the Civil Procedure final exam. Programme of the activities: base concepts: digital document - digital signature -electronic certified mail; reference legislation: DM 44/2011: technical regulations of the TelematicCivil Procedure and the specific techniques; DL 179/2012 amended by DL 90/2014 converted in Law114/2014; involved subjects: authorised external persons(lawyers and other professionals) - authorised internal persons (judges andclerks); structure of the system: the flow of the filing of theproceedings and digital communications - temporal claims: definition and value- by own notifications: reference legislation; the tools: Consolle Avvocato® (Unione LombardaOrdini Forensi) and other editor software - Clerks applications (SICID eSIECIC) - Consolle del Magistrato - Technical infrastructure of thetelematic proceeding.

Badge Criteria

To obtain this Badge one must participate in the Telematic Civil Procedure-a training course and pass the final exam. The course is open to all students regularly enrolled at the University of Milano-Bicocca. It is especially directed to those enrolled in the Bachelor’s degree course in Legal Services and in the Master’s Degree course in Law who already have taken or are taking the Civil Procedure course. The acquisition of said knowledge and skills will be verified through a multimedia test.
